Last month, a jury ordered Samsung to pay Apple $539M for infringing on its patents. Now, the Korean company wants that decision thrown out.

It again says it should pay a far, far smaller amount for stealing many of the design elements of the iPhone.

Wrangling over Samsung patent infringement payment

Back in 2012, a jury decided that Samsung phones released in 2011 infringed on Apple patents. After years of post-trial legal wrangling, a new jury was impaneled in May of this year to determine how much Samsung must pay Apple in damages. 

Apple wanted a $1B. Samsung said the amount should be just $28 million. The amount awarded was $539M, essentially right down the middle of the two requests. 

But Samsung’s lawyers aren’t giving up yet. They went to the judge to argue that “no reasonable jury” would have come come to that decision, according to Law360.

Their motion said “The jury’s verdict is excessive and against the weight of the evidence on each and every issue identified above, and … the evidence supports a verdict of no more than $28.085 million.”

Apple, of course, has a different take. After the jury ruled that Samsung must pay $539M, a statement from the iPhone maker said “It is a fact that Samsung blatantly copied our design. We’re grateful to the jury for their service and pleased they agree that Samsung should pay for copying our products.”

The judge in last month’s case has not yet ruled on Samsung’s latest motion. The Korean iPhone giant is asking for a summary judgment, or for a new trial.
